These Accommodation Terms & Conditions apply to all guests staying at our thatched-roof private house accommodations operated under MIYAMA FUTON & BREAKFAST.

This document also includes our house rules and sauna rules.

Article 1 (Scope of Application)

The accommodation contracts concluded by this facility and all related agreements shall be governed by these Terms & Conditions.
Matters not stipulated herein shall be governed by applicable laws and regulations or customary practices.

Notwithstanding the preceding paragraph, if this facility agrees to special provisions within the scope that does not conflict with the purpose of these Terms & Conditions, laws, or customary practices, such special provisions shall take precedence.

Article 2 (Application for Accommodation Reservation)

A person applying for an accommodation reservation must provide the following information to this facility:

  • Name of guest(s)
  • Date(s) of stay and expected arrival time
  • Name and contact information of the applicant, and the name and contact information of the person responsible for payment
  • Other information deemed necessary by this facility

If a guest requests to extend the stay beyond the originally reserved date during the stay, such request shall be treated as a new reservation request only when there is availability.
The new accommodation contract shall be considered concluded when this facility accepts the request and the guest makes advance payment of the accommodation fee.

Article 3 (Payment of Reservation Deposit)

The applicant must pay a reservation deposit of JPY 30,000 within seven (7) days from the day following the application date, using the method specified by this facility.
Bank transfer fees shall be borne by the guest.

Even if consecutive stays are reserved, only JPY 30,000 (equivalent to one night) will be required as a deposit.
However, if the accommodation fee per night exceeds JPY 100,000, the guest must pay JPY 30,000 multiplied by the number of nights reserved.

The deposit shall first be applied to the total accommodation fee payable by the guest.
If a situation arises where Article 7 or Article 19 applies, the deposit shall be applied in the following order: cancellation fees, then compensation for damages.
Any remaining balance shall be refunded at the time of payment as provided in Article 12.

Article 4 (Conclusion of Accommodation Contract)

The accommodation contract shall be deemed concluded when this facility confirms receipt of the reservation deposit specified in Article 3.
The order of contract conclusion shall follow the order in which reservation applications were received as provided in Article 2.

If the reservation deposit is not paid by the deadline specified in Article 3, Paragraph 1, this facility shall treat the reservation as if it had not been made.

Once the accommodation contract is concluded, changes to the accommodation date cannot be accepted.
If the guest wishes to change the date for personal reasons, the guest must cancel the existing accommodation contract in accordance with Article 7 and submit a new reservation request.

Article 5 (Special Provisions Where Deposit Is Not Required)

Notwithstanding Article 3, this facility may accept special provisions under which the payment of a reservation deposit is not required.

Article 6 (Refusal to Conclude an Accommodation Contract)

This facility may refuse to conclude an accommodation contract in the following cases:

  1. When the reservation application does not comply with these Terms & Conditions
  2. When there is no availability due to full occupancy
  3. When the applicant is deemed likely to engage in conduct that violates laws, public order, or morals
  4. When the applicant is deemed to fall under any of the following:
    • Organized crime groups as defined in Article 2, Paragraph 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members
    • Members of such organized crime groups, related persons, or other antisocial forces
    • Corporations or organizations controlled by organized crime groups or their members
    • Corporations whose officers include organized crime group members
  5. When the applicant has acted in a manner that causes significant nuisance to other guests
  6. When the applicant is clearly recognized as having an infectious disease
  7. When violent demands are made, or unreasonable burdens beyond a reasonable scope are requested
  8. When accommodation cannot be provided due to natural disasters, facility failure, or other unavoidable reasons
  9. When the applicant is heavily intoxicated and deemed likely to cause serious nuisance to neighbors or other guests
  10. When the applicant brings in dangerous items (heating appliances, petroleum products, firearms, swords, etc.) or items harmful to the human body
  11. When the case falls under Article 5 of the Kyoto Prefecture Ryokan Business Act Enforcement Ordinance
  12. When the applicant has previously been subject to Article 10
Article 7 (Right of Guest to Cancel the Contract)

The guest may cancel the accommodation contract by notifying this facility.

If the applicant cancels all or part of the reservation (including meals, ingredients, services, or purchases reserved in advance), this facility shall charge a cancellation fee as follows:

The previous day 70% of total accommodation fee
From 4 days before 50% of total accommodation fee
From 7 days before 30% of total accommodation fee
From 14 days before 20% of total accommodation fee
From 20 days before 10% of total accommodation fee

*Percentages indicate the ratio of the cancellation fee to the accommodation fee (Appendix 1).

If the number of reserved nights is shortened, the cancellation fee will be calculated based on one day (the first day), regardless of the shortened number of days.

If a guest fails to arrive without notice by 6:00 PM on the day of arrival, or if the guest arrives more than two (2) hours later than the expected arrival time (up to 8:00 PM) without contacting the facility, the reservation may be treated as canceled by the guest.

If the guest proves that the failure to arrive without notice was due to unavoidable reasons not attributable to the guest, such as delays or cancellations of public transportation, the cancellation fee will not be charged.
However, this applies only when the guest has contacted the facility.

Article 8 (Guest Registration)

On the day of arrival, guests must register the following information at the check-in center of this facility:

  • Name, date of birth, gender, address, and occupation
  • For foreign nationals: nationality, passport number, port of entry, date of entry, and (if applicable) the place of stay before and after
  • For foreign nationals without an address in Japan: a copy of the passport in addition to the above
  • Departure date and expected departure time
  • Names of accompanying persons
  • Other matters deemed necessary by this facility

Guests who do not have an address in Japan will be requested to present their passport and allow copying of the passport.

Article 9 (Hours of Use of Guest Rooms)

Check-in time is from 3:00 PM to 7:00 PM. Guests checking in after 7:00 PM will be charged an additional fee.
Check-out time is by 10:00 AM.

This facility may, only when possible, allow the use of facilities and premises outside the above hours. In such cases, additional charges will apply as follows:

Early Check-in
From 1:00 PM to 3:00 PM: JPY 7,000 or JPY 5,000 per hour
Late Check-in
From 7:00 PM to 10:00 PM: JPY 10,000
Late Check-out
From 10:00 AM to 12:00 PM: JPY 7,000 per hour
After 12:00 PM: charged as one additional night

For consecutive stays of two (2) nights or more, guests may use the facility all day except on the day of arrival and the day of departure.

Article 10 (Right of the Facility to Cancel the Contract)

This facility may cancel the accommodation contract even during the accommodation period in the following cases:

  • When any of the items in Article 6 (3) through (12) applies
  • When persons other than registered guests are allowed to enter the guest rooms
  • When guests do not comply with prohibited acts under the facility’s rules (limited to those necessary for fire prevention), such as smoking outside designated areas, smoking in bed, etc.
  • When false information is found in the registration details or declarations under Article 7
Article 11 (Compliance with House Rules)

Guests must comply with the “House Rules” established by this facility while staying on the premises.

Article 12 (Payment of Charges)

The breakdown of accommodation charges and other fees payable by guests is as stated in Appendix 1.

Payment for accommodation charges and other fees shall be made at the check-in center either in currency or by accommodation vouchers, credit cards, or other methods approved by this facility, at the time of departure or when requested by the facility.

Even if a guest voluntarily does not stay after the room has been provided and made available, the accommodation fee will still be charged.

Article 13 (Liability of the Facility)

This facility shall compensate guests for damages caused by the performance or non-performance of the accommodation contract and related agreements.
However, this does not apply when such damages are not attributable to this facility.

Article 14 (Handling When Contracted Services Cannot Be Provided)

If this facility is unable to provide the contracted services, it will, with the guest’s consent, make every effort to arrange alternative accommodation under the same conditions.

If this facility is unable to arrange alternative accommodation, it will pay compensation equivalent to the cancellation fee amount, which shall be deemed equivalent to the amount of damages.
However, no compensation shall be paid if the inability to provide accommodation is not attributable to this facility.

Article 15 (Handling of Deposited Items)

This facility does not accept deposited items.
The facility shall not be liable for loss, damage, or destruction of items, cash, or valuables brought into the premises by guests.

Article 16 (Storage of Guests’ Baggage and Personal Belongings)

This facility cannot accept or store guests’ valuables or baggage prior to the stay.

If a guest leaves baggage or personal belongings (including items left in safes) after check-out, this facility will store them for seven (7) days including the day of discovery.
After that period, valuables will be delivered to the nearest police station, and other items may be disposed of.

Article 17 (Parking Responsibility)

This facility provides a free parking space for guests. However, this is merely the provision of space, and the facility does not assume responsibility for the management of vehicles.

Article 18 (Disclaimer)

Guests shall use communication devices such as computers at their own responsibility within the facility.
This facility shall not be liable for any damages incurred by guests due to system failure or other reasons that interrupt services.

Article 19 (Liability of Guests)

If this facility suffers damages due to the intentional act or negligence of a guest, the guest may be required to compensate this facility for such damages.

  • The facility shall not be responsible for accidents caused by guests who fail to comply with the posted house rules.
  • If equipment, furniture, or fixtures are damaged or stained due to the guest’s intentional act or negligence, the guest must report it immediately.
    If the guest leaves without reporting, the full cost of repair or replacement will be charged.
    If reported, the facility will apply insurance coverage where possible.
  • If a guest vomits due to intoxication and stains bedding or the facility, making the room unusable, or if damage occurs due to violent or improper use,
    the guest will be charged for cleaning costs and damages, including compensation for lost business during the repair period.
Article 20 (Governing Law and Jurisdiction)

Any disputes arising in connection with these Terms & Conditions shall be resolved in accordance with Japanese law,
under the exclusive jurisdiction of the Kyoto District Court or the Kyoto Summary Court, which has jurisdiction over the location of this facility.

Notes:

  • Basic fees and additional charges are based on the amounts published by this facility at the time of reservation.
  • Infants and toddlers stay free of charge (no bedding or breakfast will be provided).

House Rules & Sauna Rules
MIYAMA FUTON & BREAKFAST
 

To maintain the safety, comfort, and public nature of our facility, all guests are required to follow the rules below in accordance with Article 11 of our Accommodation Terms & Conditions.

If these rules are not followed, we may refuse continued accommodation under Article 10.

House Rules
  • Entry into the facility by persons who are not registered guests is strictly prohibited in principle.
    If unregistered persons enter, the same accommodation fee will be charged for overnight stays, and a facility usage fee will be charged for day-use visits.
  • Do not use fire or heating appliances that may cause fire inside the facility.
  • Smoking is strictly prohibited throughout the entire premises. (No smoking anywhere on site.)
  • This facility is a wooden structure located in a quiet residential area.
    Please refrain from loud singing, shouting, noisy behavior, or any conduct that may disturb neighbors or cause discomfort to others.
  • Guests must not bring the following items into the facility:
    • Animals or birds
    • Items emitting strong odors
    • Excessively large quantities of goods
    • Explosives, gasoline, or other flammable or combustible materials
    • Firearms, swords, or other weapons not legally permitted
    • Cannabis, narcotics, stimulants, or other illegal drugs
  • Gambling or any behavior that disrupts public morals is strictly prohibited.
  • Guests must not invite outside visitors into the facility without permission, nor move, modify, remove, or use facility equipment or furnishings for purposes other than intended.
  • Do not attach foreign objects to the building or move facility equipment to other locations within the premises.
  • Guests who are heavily intoxicated may be refused use of the bath.
Facility Operating Hours

Guests must comply with the following operating hours posted by the facility.
These hours may be changed temporarily when necessary, in which case guests will be informed appropriately.

  • Front Desk Service: 8:30 AM – 5:30 PM
  • Breakfast Time: Generally 8:00 AM (flexible), available between 7:30 AM – 9:00 AM
  • Additional Service Facilities: 10:30 AM – 10:00 PM
 
Sauna Rules

To ensure all guests can enjoy the sauna safely and comfortably, we have established the following sauna rules.

For Safe Use
  • If you are not feeling well, please refrain from using the sauna.
  • There is no strict time limit for sauna use during your stay. However, please be considerate of nearby residents and avoid disturbing noise.
  • Always turn off the power after use.
  • If damage or staining occurs due to usage beyond normal conditions, guests will be required to compensate the full cost of repairs or restoration.
  • Sauna use after drinking alcohol is strictly prohibited.
  • Pouring water onto sauna stones can generate steam instantly. Please be careful to avoid burns.
Rules for Hotaruan Sauna
  • Before entering the sauna (including after outdoor cooling), please wash your body using the shower.
  • Alcoholic beverages are not permitted inside the sauna room.
  • Wearing jewelry or accessories in the sauna may cause burns. Please remove them before use.
  • Do not pour large amounts of water onto the sauna stones at once.
    Excess water may not evaporate properly and may damage the electric stove.
    If a malfunction occurs due to excessive water use, guests will be charged repair costs and related damages.
  • For safety reasons, the maximum temperature is set to 90°C.
    Please do not change the settings of the safety device dial located on the front-left side inside the sauna.
  • The facility assumes no responsibility for accidents during sauna use or any physical condition changes after bathing.
